The present website, www.climergia.gr (hereinafter referred to as the “Site”), is the website of CLIMERGIA ENERGY AND CLIMATE INVESTMENTS SINGLE MEMBER P.C (hereinafter referred to as “CLIMERGIA”) and REIDDL Technology and Strategy Consultants Single Member Private Company (hereinafter referred to as “REIDDL”), both (hereinafter referred to as the “Companies” or “we”) based in Athens, Pythodorou 18-22, postcode 10441, TIN (AFM) 801601131, Tax Office (DOY) A’ Athens.

CLIMERGIA is a climate consulting and green energy equipment-provider company, that aims to make our world greener by helping you design and implement the most complex green projects you may possibly think of. REIDDL is a technology and strategy consulting and smart-solutions-provider company specializing in digital data. Through our Site we introduce ourselves, present our services, inform you on related issues and allow you to contact us in various ways to have your questions answered and benefit from our services.

Accessing, using and browsing the Site is free and does not impose any financial obligations on the visitors / users. The services provided by the Companies through the Site are covered exclusively by these Terms of Use, including our Privacy Policy and Cookie Policy, which form an integral part of these Terms of Use, and any other terms and conditions are expressly excluded. Any visitor / user who visits the Site or interacts with the Site shall be deemed to consent to and unconditionally accept the terms set forth herein, without exception, and understand that these terms constitute a legally binding Agreement between the visitors / users and the Companies. 

If you do not agree with these terms, you must refrain from using the Site and its services. The Companies reserve the right to change the Terms of Use at any time. The visitors / users should periodically check the terms to keep themselves informed of their content and are solely responsible for staying up to date. 

These terms apply to both those who just visit the Site and those who interact with the Site in any way (hereinafter referred to as the “users / user”). 

You do not need to provide any personally identifiable information to use the Site. Personal data of yours will only be requested if you wish to contact us via our contact form or otherwise.

The user is responsible for accessing the services of the Site and such access may require the payment of fees to third parties (e.g. internet service providers). The user is solely responsible for paying the relevant fees. Furthermore, the users are solely responsible for equipping themselves with the necessary technological means to access the services of the Site.

Given the nature and volume of the Internet, the Companies are not liable, under any circumstances, including negligence, for any form of damage suffered by the user of the pages, services, options and contents of the Site. The contents of the Site are provided “as is” without any guarantee, expressed or implied in any way. To the fullest extent permitted by law, the Companies disclaim all warranties, expressed or implied, including but not limited to those implying merchantability and appropriacy for any particular purpose.

The Companies carefully control the level of security of the services they offer  in the digital environment, using programs against the spreading of viruses and malware. It is recommended that the users use software to protect themselves against computer viruses, Trojan horses, time bombs, etc, while browsing the Site. The Companies are not liable for any damage to the user’s devices (hardware), programs (software) and user data, as well as for any other type of damage to the user or third parties, from the risks described above, provided that the Companies fulfil their legal obligations concerning the necessary precautions and the necessary security and damage prevention measures. The Companies make every effort to provide high quality services, however they do not guarantee that the pages, services, options and contents of the Site will be provided without interruption, without errors and that errors will be corrected. It also does not guarantee that the Site or any other related website or the servers through which they are made available to the users are free of viruses or other harmful components.

The Companies do not guarantee, under any circumstances, the correctness, completeness or availability of the contents, pages, services, options or their results. The information, articles and all the content on the Site is provided for informational purposes and is used at the user’s risk and subject to the provisions of the law.

 

  1. Responsibility of the User

Every user is free to use the Site in accordance with the law and the accepted principles of morality. The responsibility for the content of the interactions belongs exclusively to the user. The Companies do not exercise any kind of correction or intervention in the data transmitted by the users. The users are required to fill in correctly and accurately the fields of name, surname, telephone, e-mail, message in the online contact form, as well as the data requested in each case to enable us to provide our services. The use of the Site is subject to the Greek, European and international laws and the user agrees not to use the Site in violation of these laws. In the context of the above, the users agree and assume the responsibility not to use the Site for:

  1. sending, publishing or otherwise transmitting any content that is illegal for any reason, causes unlawful injury or damage to the Companies or any third party, or violates the confidentiality or privacy of any person’s information,
  2. sending, publishing or otherwise transmitting any content that offends the accepted principles of morality, social values, minors, etc,
  3. sending, publishing or otherwise transmitting any content which they do not have the right to transmit under the law or applicable contracts (such as inside information, proprietary and confidential information acquired or disclosed as part of employment relationships or covered by confidentiality agreements),
  4. sending, publishing or otherwise transmitting any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of third parties,
  5. sending, publishing or otherwise transmitting any material that contains software viruses or any other codes, files or programs designed to damage, destroy or disrupt the operation of any software or computer hardware,
  6. intentionally or unintentionally violating applicable laws and harassing third parties in any way,
  7. collecting or storing personal data of other users.

The users assume responsibility for any damage caused to the Companies by improper or unauthorized use of the Site. 

In addition, the users understand and agree that the partners, the administration, the employees, the members and the associates of the Companies are not liable for anything arising from third parties using the Site. 

Any use contrary to the above will result in the termination of the provision of our services without notice, in addition to any legal penalties.

 

  1. Intellectual Property Rights

Without prejudice to the intellectual property rights of third parties, the entire content of the Site, including distinctive marks, trademarks, images, graphics, photographs, drawings, texts, constitutes intellectual property of the Companies and is protected under the relevant provisions of the Greek law, the European law and the international conventions. In particular, names, images, logos and distinctive marks that represent our Site and services or third parties and their products or services are exclusive distinctive marks / trademarks of the Companies or third parties respectively, protected by the relevant trademark and industrial property laws. Their presence on the Site should in no way be construed as a transfer or assignment of any license or right to use them. The present Site, www.climergia.gr, is also independently protected as an original work of visual design and applied arts, according to the specific provisions of the law, as well as a collection of works (Article 2, Greek Law 2121/1993) and constitutes intellectual property of the Company.

Any copying, analog / digital recording and mechanical reproduction, distribution, transfer, downloading or creation of derivative works based on this content or misleading the public about the actual provider of the Site is prohibited.  Reproduction, dissemination, transmission, retransmission of the material or any other use of the content in any manner or means for commercial or other purposes is only permitted with the prior written consent of the Companies or any other holder of the intellectual property rights.

 

  1. Start – Interruption of Service

The Companies reserve the right to modify and / or temporarily or permanently discontinue part or all of the Site’s services with or without notice to the users.

The Companies also reserve the right to deny or restrict access to the Site to any particular person or to block access from a particular Internet address to the Site, at any time, without ascribing any reasons whatsoever.

We do not control the availability, the content, the privacy policy, the quality and the completeness of the services of other websites and webpages, to which we refer through links, hyperlinks or banners. Therefore, for any problem that may arise during their use, the user must address directly to the respective websites and webpages, which are responsible for the provision of their services. The links on the Site are provided for the convenience of the user or for advertising purposes and we do not, in any case, approve, do not accept and are not responsible for the content of any link.

Furthermore, it is up to the users of the Site to take precautions to ensure that the links they select or the software programs they download (whether from the Site or any other website) do not contain items such as viruses, worms, Trojan horses, defects and other destructive elements.

If any provision of these Terms of Use is or becomes invalid, unenforceable or non-binding you will still be bound by all other provisions. 

If any right under this Agreement is not exercised by the Companies, it shall not be deemed to be a waiver and the right may be exercised at any time by the Companies at their sole discretion.
